In a Tuesday notice, ESMA said that derivatives products, including those marketed as “perpetual futures or perpetual contracts” tied to cryptocurrencies like Bitcoin (BTC) or Ether (ETH), likely fell within the scope of intervention measures applied to contracts for differences, or CFDs.
